Fees and Payment

Fees are non-refundable except as required by law
We may change fees upon thirty (30) days' notice
You authorize recurring charges for subscription services until cancelled

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELENVO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

Termination

We may suspend or terminate your access to our services at any time, with or without cause or notice. You may terminate your account by contacting us at support@elenvo.ai. Upon termination, your right to use our services will immediately cease.

Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from this Agreement or your use of our services shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may bring an action in small claims court if the claim qualifies.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of material changes by posting the updated terms on our platform. Your continued use of our services after such changes constitutes acceptance of the modified terms.
